1. General provisions
1.1. These Terms & Conditions (the Terms) apply to all purchases made in the online store baitera.lt.
1.2. The Terms constitute a binding agreement defining rights and obligations of the Buyer and the Seller.
1.3. By placing an order, the Buyer confirms that they have read and accepted the Terms. If the Buyer does not accept the Terms, the order may not be placed.
1.4. The Seller may amend the Terms unilaterally. The amended version becomes effective upon publication on the website and applies to new orders.
2. Definitions
2.1. Seller – MB Baitera, company code 307179345.
2.2. Buyer – a natural or legal person purchasing goods via the online store.
2.3. Parties – the Seller and the Buyer jointly.
2.4. Goods – products and/or services offered in the online store.
2.5. Contract – the sales contract concluded between the Buyer and the Seller under these Terms.
3. Conclusion of contract
3.1. The Buyer may place an order as a registered user or as a guest (if available).
3.2. The Contract is deemed concluded when the Buyer submits the order (clicks “Order” or similar) and receives confirmation that the Seller has received the order.
3.3. If the Goods are not available or the order cannot be fulfilled for objective reasons, the Seller shall inform the Buyer and refund the amount paid.
3.4. The Seller may refuse to confirm an order if the information provided is incomplete or obviously incorrect.
4. Prices and payment
4.1. Prices are indicated in EUR and include VAT. Delivery fees are not included unless stated otherwise.
4.2. The Buyer may pay using the payment methods made available by the Seller (e-banking, bank transfer, payment providers, card, cash on delivery where applicable).
4.3. If payment is not received within the time limit set by the Seller, the Seller may cancel the order.
4.4. In case of an obvious pricing error, the Seller may correct the price and inform the Buyer, who may accept the corrected price or cancel the order.
5. Delivery and pick-up
5.1. Goods are delivered within Lithuania. Delivery options and estimated delivery times are shown during checkout.
5.2. The Buyer must provide accurate delivery details. The Seller shall not be liable for delays or non-delivery caused by incorrect details.
5.3. Pick-up point (if available): Raudondvario pl. 147, LT-47192 Kaunas.
5.4. Risk transfers to the Buyer upon handover of the goods to the Buyer (or upon handover to the courier, where applicable).
5.5. Upon delivery the Buyer must inspect the parcel. If damage is noticed, the Buyer must record it in the delivery documents and/or inform the carrier and the Seller.
6. Product quality and warranty
6.1. The Seller guarantees that Goods comply with applicable legal requirements.
6.2. Some Goods may include a manufacturer’s warranty. Warranty terms are provided with the Goods and/or in manufacturer documentation.
6.3. Where Goods include digital elements, the Seller complies with applicable requirements for updates and liability for defects.
7. Right of withdrawal (returns)
7.1. Consumers have the right to withdraw from the Contract within 14 calendar days without providing any reason, unless exceptions apply under applicable law.
7.2. The withdrawal period starts from the day the Buyer (or a third party indicated by the Buyer) receives the Goods.
7.3. To exercise the right of withdrawal, the Buyer must notify the Seller by email at info@baitera.lt.
7.4. The Buyer must return the Goods no later than 14 calendar days from the withdrawal notice.

7.6. Return costs for non-defective goods shall be borne by the Buyer, unless stated otherwise by the Seller.
7.7. Refunds shall be made within 14 days of receiving the withdrawal notice; however, the Seller may withhold the refund until the Goods are received or proof of shipment is provided.
7.8. Return conditions
- Goods must be unused beyond necessary inspection;
- Goods must retain commercial appearance;
- Goods must be returned with accessories and documents (if supplied);
- if the Buyer used the Goods more than necessary, the Seller may reduce the refund proportionately.
7.9. Exceptions
The right of withdrawal may not apply in certain cases (e.g. unsealed hygiene products, custom-made Goods, etc.), depending on applicable law.
8. Defective goods
8.1. If Goods are defective, the Buyer may request repair, replacement, price reduction or termination of the Contract according to applicable law.
8.2. The Buyer must notify the Seller of defects within a reasonable time, no later than 2 months from discovery.
8.3. Costs for returning defective Goods shall be borne by the Seller.
9. Buyer’s rights and obligations
- provide accurate information during checkout;
- pay for the order on time;
- inspect the parcel upon delivery;
- use Goods according to their intended purpose and instructions.
10. Seller’s rights and obligations
- sell and deliver Goods as ordered;
- inform the Buyer about order status;
- process personal data in compliance with the Privacy Policy;
- cancel orders if payment is not received or Goods cannot be delivered.
11. Liability
11.1. The Parties shall be liable for non-performance or improper performance in accordance with applicable law.
11.2. The Seller shall not be liable for losses resulting from incorrect Buyer information or unauthorized account usage.
11.3. The Seller may limit orders showing wholesale purchasing patterns to ensure retail sales.
12. Personal data protection
12.1. The Buyer’s personal data is processed in accordance with applicable law and the Seller’s Privacy Policy.
12.2. The Privacy Policy is published on the website.
13. Notices and communication
13.1. Notices are delivered via email and/or phone number provided by the Buyer during ordering.

14. Final provisions
14.1. These Terms shall be governed by the law of the Republic of Lithuania.
14.2. Disputes shall be settled by negotiation; failing that – in accordance with Lithuanian law.
14.3. Consumers may contact the State Consumer Rights Protection Authority (VVTAT) or use the ODR platform.
In case of discrepancies between language versions, the Lithuanian version shall prevail.
